
A pair of gamers are suing Nintendo in an attempt to get some of the money back that Nintendo may end up getting for a refund. Nintendo is suing the US government over tariffs, a lawsuit which it filed after it was announced that the government would be issuing refunds over increased costs incurred from the tariffs. Nintendo, of course, will have to win its lawsuit if it’s to get any sort of refund.
This new lawsuit against Nintendo may very well hinge on that. As it’s based on the potential outcome that Nintendo even gets a refund from this tariff lawsuit. While Nintendo didn’t raise the price of the Switch 2 as a result of the tariffs, it did increase the price of the original Switch consoles and some of the Switch and Switch 2 gaming accessories. Gamers, of course, had to pay those higher prices. That seems to be what the people suing Nintendo are seeking refunds for.
Gamers suing Nintendo say the company is trying to double dip
It’s unclear whether or not the case will move forward as it has yet to be moved into a class action status by a judge, which is required, Aftermath reports. The lawsuit’s argument is that Nintendo is essentially trying to double dip by recouping money from the government after it already recouped money by charging higher prices to customers.
The lawsuit would cover any consumer who purchase goods from Nintendo between the dates of February 1, 2025 and February 24, 2026. A little more than a year. Even though the Nintendo Switch 2 price didn’t go up, its launch was right near the beginning of this time frame laid out in the claim. The Switch 2 might not be covered in terms of potential payouts if this lawsuit wins. That is unclear at the moment as it’s not mentioned what products are covered and which ones aren’t. That being said, anyone who bought a Switch 2 most likely picked up some accessories, which prices were raised on. o refunds may be entitled based on those items should things swing in the favor of gamers in this case, and if it moves forward.
