Popular pop singer Dua Lipa has reportedly filed a lawsuit against Samsung for using her image without permission to promote its televisions. The case is filed in the California federal court, and the pop star seeks at least $15 million in compensation from the brand.
Dua Lipa files a lawsuit against Samsung for using her photo without permission
As per the reports, Samsung had used the copyrighted image of Dua Lipa on its television packaging. The company did not take any formal permission from the pop star before using her image. The photograph titled “Dua Lipa – Backstage at Austin City Limits, 2024” was specifically used by the brand on cardboard boxes for televisions sold in retail stores. The singer’s legal representatives say she owns the full rights to the image and that she never gave the company permission to use it in any advertising or product packaging.
The legal documents also include screenshots of the social media promo posts. To further support their stand, the team also included a screenshot of a fan saying they would buy the television “just because Dua is on it.” Along with copyright infringement, the lawsuit also accuses Samsung of trademark infringement and violating the singer’s publicity rights. Using her image creates an impression that she endorsed or approved the products being sold to consumers. This is factually incorrect.
Samsung declines to comment on the matter
As of right now, Samsung has declined to comment on the issue. The legal team of Dua Lipa claims the issue was raised with Samsung back in June last year. However, despite repeated requests not to use the star’s image, the tech giant did not respond. They did not stop using her photos. This eventually led to the team filing a lawsuit on behalf of the singer last week. In the lawsuit, the singer’s team says Samsung’s alleged actions damaged the singer’s brand identity. The action also affected her commercial reputation by falsely suggesting she supported the products.
The court has not yet moved forward with the hearings of the lawsuit. However, if the legal body rules in favor of Dua Lipa, Samsung may have to pay hefty compensation to her. The verdict could also change how companies use popular influencers and artists’ images on their products’ promotional materials.
