This week, Insta360 officially unveiled its first-ever pocket camera, the Luna Ultra. This is in direct competition with the very popular DJI Osmo Pocket 3 (with the 4 and 4 Pro on the way). The Osmo Pocket is hugely popular. If you ever go to a tech event, there’s a good chance that 90% of the cameras there will be the Osmo Pocket in some variety.
Now, DJI has decided it is going to sue Insta360 over the new Luna cameras. There are two lawsuits that DJI has filed in a Texas District Court, alleging that Insta360 infringed on multiple patents.
The first lawsuit alleges that Insta360 infringed on design patents that DJI has. This includes using “the same product architecture pioneered by the DJI Osmo pocket.” The suit further adds that the “ornamental design” of the Insta360 Luna Pro and Ultra is similar to the design that DJI patented. DJI is claiming that pretty much everything about the Luna Pro and Ultra is covered by two separate patents held by DJI.
The second lawsuit alleges that Insta360 violates four of DJI’s utility patents. Including a patent that describes a control device that allows a gimbal to switch between locked and follow modes with a single button. A second patent that describes a method for a gimbal to detect and track a subject.
The third patent describes a control method in which the device uses the image it captures to provide gimbal commands for movement and subject tracking. And the final patent describes a “self-contained system for tracking a subject and displaying the image, without the need for a separate application.”
This isn’t the first time DJI has sued Insta360
Unsurprisingly, this isn’t the first time that DJI has sued Insta360. DJI filed a lawsuit alleging that Insta360 infringed on its patents for its drone imaging tech. The lawsuit was filed in China, and we all know how much China cares about patent infringement.
DJI is asking that the court order Insta360 to pay damages, a share of Insta360’s profits, and supplemental damages, including pre-judgment and post-judgment interest. Interesting that DJI is not looking for a sales injunction, limiting Insta360 from selling the Luna series.
