Apple is reportedly seeking settlement talks with Epic Games, and has petitioned the court to basically force the two companies into discussion about a possible settlement. In other words, Apple is ready to talk terms. Apple’s latest request is quite different from its position on the case just a few months ago.
Back in May, Apple had requested a Supreme Court stay in its case against Epic in hopes that the Supreme Court would reverse the injunction after it heard Apple plead its case. Epic then followed this request in June with a request of its own, asking the court to ignore Apple’s petition, noting that the request was nothing more than another stall tactic by Apple. In July, Apple appealed a contempt ruling given to it by the court, and the Supreme Court decided it would hear Apple’s case. Then on August 13, Apple was denied its request to delay the case further.
Apple wants to the court to force settlement talks with Epic
While Apple hasn’t entered into settlement talks or reached a settlement with Epic Games yet, it’s hoping that settlement talks will begin soon. The company has reportedly submitted a proposal that asks the court to force it and Epic into a settlement conference that would be had before Magistrate Judge Joseph C. Spero. Apple also approached Epic Games first, with the company’s lawyers requesting settlement discussions, but Epic did not want to enter discussions.
Now Apple is hoping that the court will decide to force discussions on its behalf. In Apple’s proposal the company also details what it wants to charge for a commission on any purchase made by users outside of the App Store. This follows Apple’s initial attempt to charge fees, which is what led to Apple being found in violation of Judge Yvonne Gonzalez’s initial injunction.
