
The court case between Apple and Epic Games that began with the ban of Fortnite from the App Store is back in court yet again, as Apple refuses to take the loss it was given following the initial court ruling that took place back in 2021.
If you’re unfamiliar with the case, Apple banned Fortnite from the App Store back in 2020 after Epic pushed an update to Fortnite that allowed it to skirt the App Store payment processing system. Apple didn’t like this, given that it would potentially lose out on tons of money from App Store purchases that would usually earn it a cut. So, it banned Fortnite for breaking the rules, and then Epic sued. Epic then won its case, though Apple has continued to fight tooth and nail to get the ruling overturned. Now, the company is back in court after escalating the appeal.
Apple is determined to get the Fortnite court case ruling overturned
This week, Apple is back in court, making an attempt to have the initial ruling from 2021 overturned. As reported by Bloomberg (via 9To5Mac), Apple and Epic had a deposition in court this week, where Apple presented its arguments. The company has said that the original ruling from 2021 “breaches well-established guardrails on the civil contempt power.”
As of right now, there’s no complete information on what exactly was said during the deposition, and it’s still unclear how the deposition ended up for both companies. Realistically, it’s likely that details about the deposition will surface over the next week or so.
Does Apple have a chance to overturn things?
Anything is possible, but after two appeals following an initial ruling that has so far been upheld, plus an attempt to get a new judge, it seems less likely. That being said, there’s no way to know for sure. Eventually, Apple won’t be able to take this case any further.
For now, it’s continuing to fight the ruling in hopes that it can put things back the way they were. Which is the ability to deny alternate forms of payment processing, so developers have to use the App Store.
